The Executive Council of the Federation today passed a resolution that ailing President Umaru Yar’Adua is capable of discharging the functions of his office.
This its reaction to the ruling of Justice Dan Abutu on 22 January that it should pass a resolution on whether President Umaru Yar’Adua is capable of continuing in office in line with section 144 of the 1999 constitution of the Federal Republic of Nigeria within 14 days.
The Executive Council also resolved that the President seeking medical treatment outside the country does not constitute incapacity to warrant invocation of the process of the removal of the President under section 144 and 146 of the constitution of the Federal Republic of Nigeria.
Mike Aondoakaa, Attorney General of the Federation and Minister of Justice who briefed State House Correspondents on the resolution of the Executive Council, refused to expatiate on the process through which the body arrived at the decision.
On whether a medical panel was consulted over the issue before the Executive Council to reached the decision, the minister said the constitution did not make provision for it.
“The issue of medical panel comes after the decision has been made,” Aondoakaa, who was combative throughout the press briefing told reporters.
The minister insisted that the VP has been performing all the functions that the president can perform and has been giving orders to ministers who have been obeying him.
But when he was asked if the VP in exercising the powers of the president can dissolve the Federal Executive Council, Andoakaa said the question is speculative and he will not answer it.
The minister later stormed out of the briefing, leaving journalists confounded.
Meanwhile, the Senate today demanded ailing president take steps to transfer power to his deputy in accordance with the country’s constitution.
“We urge President Yar’Adua to formally notify the National Assembly of his medical vacation,” as demanded by the constitution, the Senate President, David Mark told AFP at the end of a two-day debate on the president’s health.
The constitution states that whenever the head of state informs the parliament of his absence, then the vice president can act on his behalf.
The 58-year-old president has been treated for a heart condition in Saudi Arabia since November 23.

Noone again should go to the streets to demostrate asking Yar’Adua to leave. I beg he can rule from even from Lungu. Why should some mindless Nigerians be advocating for a dying president when the country is on a disarray. I think the National Assembly and the Senate must think and put their selfish ambition aside for the sake of the 150 million Nigerians.
