2 Teenagers Docked For Battering, Raping Housewife

Two young men, Kingsley Asuquo, 18, and Johnson Joseph, 22, have been arraigned before an Ikeja senior magistrate’s court on a four-count charge of conspiracy, battering, having carnal knowledge of a housewife, Kate Moses, and stealing her handset and money.

According to the police charge sheet, Kingsley and Joseph allegedly committed the act on 1 September, 2008, at Gowon Estate, near Egbeda, in Lagos.

The prosecutor, Inspector L.O. Mamah, said the defendant beat 23-year-old Kate Moses with fists and injured her on the forehead. The victim’s Nokia 6070, which they stole, was valued at N12,500 and another N3,000.

Police said the offences are contrary to, and punishable under, sections 516, 355, 358 and 90 of the Criminal Code Cap 17 Vol. 11 Laws of Lagos State of Nigeria 2003.

When the charges brought against them were read, the defendants denied the charges. Their counsel, Akin Suberu, pleaded that the defendants be admitted on bail. Senior Magistrate A. A. Adefulire admitted each of them on bail in the sum of N250,000 with two sureties in like sum.

The sureties must be blood relations of each of the defendants, each of them must be gainfully employed, while the court orderly will verify the addresses of the sureties. The case was adjourned till 15 September, 2008.

    The alleged offense of theft is a bailable offense but that of rape should have attracted a higher bond than 250,000 naira. The charge of battering should have been, aggravated assault and that of having carnal knowledge should be Rape.
