By Nnamdi Felix /Abuja
The Attorney-General of the Federation and Minister of Justice, Chief Michael Aondoakaa, this morning before a federal high court sitting in Abuja, affirmed that the President Olusegun Obasanjo-led Federal Government had no business awarding a N37 billion primary health care contract during his tenure.
He said the contract was awarded at the twilight of the administration of Obasanjo. Aondoaka stated that the business of primary health care lies with the local government administration.
The minister affirmed further that the present administration under Yar’Adua whose code of conduct is due process and rule of law, would not continue with the rape of the constitution which the deduction of local government funds support.

P.M.News recalls that the Obasanjo administration awarded the primary health care contract to the private construction firm, Mathan Nig. Ltd., to construct health centres in all the 774 local government areas in the country.
The contract was revoked by the National Executive Council presided over by President Umaru Yar-Adua. The NEC maintained that the contract was awarded in error as the federal government has no business interfering in primary health care issues.
The company had earlier dragged the Federal Government to court to challenge the revocation of the contract which it stated was not awarded by the Federal Government, but by the Association of Local Governments of Nigeria (ALGON).
Counsel to the company, Chief Adegboyea Awolowo (SAN), maintained that the Federal Government had no power to revoke a contract which it did not award, adding that the contract was between Mathan and ALGON, and that government’s position was that of a guarantor.
He pleaded with the court to order the Federal Government to defreeze the account of the company at the Central Bank to enable the company access the fund so far deducted from the local government statutory allocations to enable the company offset its indebtedness to its sub-contractors who are already threatening to drag the company to court over the delay in payment for jobs done.
The matter was adjourned till Thursday 24 July, for continuation.

21 July 2008 16:53Haba! When shall bad news stop trailing OBJ’s household !! O God of Host, Your words shall never go unfulfilled. You have said it that Whoever good is done and repays with bad that bad things shall never cease to exist in his household. Nigeria has done much good to OBJ but he has repaid Nigeria and her people with bad.

21 July 2008 17:08As the AG to the federation, i believe he knows that either the President or Governors have right to award contract(s) whether twilight or dusk or dawn to their administration. And as carried by PM news, which one should we believe, the PM news reported that AG claimed that the contract was awarded by Federal Government while the Company confirmed that it was Local Govts. of Nigeria (ALGON) that awarded the contract. Lets wait to see the end of the matter because PM news is very bias.

21 July 2008 17:25Hi Oguntee:
Thanks for your informed position on this issue. Though, be prepared to read outrageous remarks from the likes of ‘Tunde Ayeni. The question before the court is who awarded the contract- FG or ALGON? Has ALGON affirmed that they were not the one that awarded the contract? If a contract is awarded in error can it be unilaterally cancelled without compensation/penalty?
Na siddon look I dey too.

21 July 2008 17:29Oguntee! Haba!

21 July 2008 18:16The honourable Minister has a very distorted mind and his brain’s contents is always full of Shit & Rut.. He is just a Hired gun of some jobless politicians withing the North to discredit many good things OBJ did for this country. Well, Honourable Minister Aondoakaa knows the position of Law on the said Contract, he is just on sinister mission on OBJ as dictated by his Almajere brothers. On the side of PM News, I know very well that PM New are always looking for anynews that speaks ill of OBJ, while I wont blame them because the hungry and Brown envelop elements in the PM News management are doing the bidding of thier disrespectful Benefactors… Let the court determine….. 21 July 2008 19:29Let us wait for Umar Yar’dua’s regime action maybe Obasanjo might be asked to appear before the same panel to give his own side of the matter? But with Yar’dua, all unconstitutional, illegal acts and corruptions under Obasanjo are swept under carpet because Obasanjo is his mentor and GOd father.Yar’dua is not promoting any fight against corruption but aiding and abbetting such and committing such. 21 July 2008 20:01ALCON had not come out to say they know nothing about the said contract.Lets not be sentimental over this issue until the court in which we believe is the last hope of the common man has pass its verdict on the matter.

21 July 2008 20:53Well, is there any corporate body bearing ALGON who can sue or be sued? I believe Chief Awomolo knows what he is standing in for. I do not think it is a matter for the FGN to sign a contract on behalf of so called ALGON. Otherwise who are those who signed on behalf of the so called ALGON before FGN stood up to guarantee? Yeye dey smell!

21 July 2008 21:07AK47, Is there any misappropriation that has been uncovered since the present administration started look at the past misrule that OBJ’s househood has not been linked? I stand to be corrected. Is he the only past rulers dead or alive in Nigeria? When we asked Chief awolowo how he succeeded in the old West and others have not been able to mustard formidable team like him since then, he said, the present rulers were not sincere in their hearts to ake Nigeria great, hence they always attract people of questionable characters to themselves. OBJ might not be directly involved but he did not meant well for Nigeria thats why it attracted to himself the likes of Odili, who despite galring evidences that he was jail several times in the past. If OBJ did not see what was wrong in what Adedibu was doing in Ibadan, can u then say that he meant well for Nigeria Mr. AK47 ? If OBJ could say that 2007 was a do-or-die affair, are u now telling the downtrodden masses of Nigeria that OBJ meant well for Nigeria despite the fact that he was supposed to be the most blessed man ever created by God in Nigeria ? If OBJ met 4000 megawatt power generation and left it at 1000 megawatt, Mr.AK47, are u saying that OBJ had been sincere to Nigeria that made him cown prince of Nig. civil was and two times No.1 citizens?
If OBJ who had 20,000 naira in his Bank account in 1989 when he was released from prison is now a proud owner of a university while he closed down the entire University system for over 7 months in 2002/2003, are u telling Nigeria and her people that OBJ meant well for Nigerian youths and children yet unborn Mr. AK47? I will advice u to read what Oluwa Logbon Motors, chief Bakare and chief kaka wrote about OBJ, then u will know that OBJ did not meant well for Nigeria, hence bad things continue to trail his househood.

22 July 2008 12:58The sins of OBJ is already being visited on his children’s life (at least the known ones). Gbenga has problem with wife; Iyabo has problem with husband (with multiple scandal). Who says God is not alive. As for people like AK47 (that nick name has defined his life!), we leave him and his likes in the hand of same God that is visiting OBJ to do justice to them.
Babatunde Ayeni - you are wrong! OBJ had no N20,000 in his account in 1998. He was actually bankrupt! Today, our ‘holier than thou’ kinsman is (apart from the university, rejuvenated Ota Farm, etc, etc), the proud owner of a 45-room mansion! All hail the undisputed Anini of our time!!!

22 July 2008 13:16Inshort, Nigeria lose billions of dollar during Obasanjo regime. the revelations is good but what can or what have we done about all this ?
Its very sad to read news of money been lost in Nigeria everyday while some Nigerians have no garri to soak and to make the matter worst, its the people who can be said to own the resources with which Nigerian make this billions of dollar that is surffering most.
Which of all the allegations against OBJ has He come out to defend ? and He always claim to be the most law abiding citizen.

22 July 2008 14:09i knew he was a joker when he started his accountability brouhaha. and when every1 was crying about the removal of his RFCC tool Ribadu. he used the innocent boy to haunt his enemy and pool wool over our face to rob us. infact im currently having my best time because i always tell people that he will be put to shame along with his cohorts

22 July 2008 15:23But to say the truth as it is in my own mind i’ve not seen the Govt that has that gut to even doing anything to Obasanjo we should not forget so soon that the president was handpicked by obasanjo, he campaigned vigorously for the man even when he fell sick during campaign Obasanjo was there to carry on let me tell you they are looking for ways to give the contract to their own loyalists and you have to give dog a bad name for you to hang it this is the issue ”OLE GBE OLE GBA” meaning thief stole and another thief stole it again from the latter period.
